1. Agreement to Terms

By accessing, browsing, or placing an order on this website, you agree to be bound by these Terms & Conditions (“Terms”), including all referenced policies. If you do not agree, you may not place an order.

These Terms apply to all purchases, whether placed online, via quote, invoice, email, or any other ordering method.

2. Products & Use

Our products are designed for professional, commercial, event, and temporary installation use unless otherwise stated.

  • Installation, use, and suitability are the sole responsibility of the purchaser
  • We make no guarantees regarding compatibility with third-party systems unless explicitly stated in writing
  • Product specifications are subject to change without notice

3. Pricing & Payments

  • All prices are listed in U.S. dollars unless otherwise stated
  • Prices are subject to change without notice
  • Payment must be received in full prior to shipment unless otherwise agreed in writing
  • Taxes, duties, tariffs, brokerage, and fees are the responsibility of the customer

4. Order Acceptance & Cancellation

  • Orders are not considered accepted until payment has cleared and the order has been released for fulfillment
  • We reserve the right to cancel or refuse any order at our discretion
  • Orders that have entered processing, manufacturing, or shipment cannot be canceled

5. Shipping & Delivery

Processing Time

  • Orders are processed within 24 hours or the next business day
  • Orders placed before 2:00 PM EST may qualify for same-day processing for small parcel shipments

Shipping Methods

Products may ship via:

  • Small parcel carriers (UPS, FedEx, DHL, etc.)
  • LTL freight carriers due to size, weight, or crating requirements

Freight & Accessorial Charges

LTL shipments may require:

  • Delivery appointments
  • Lift gate service
  • Limited-access delivery
  • Inside delivery

These services are not included by default and may result in additional charges billed to the customer.

Delivery Estimates

All delivery times are estimates only and not guaranteed. We are not responsible for delays caused by:

  • Carriers
  • Weather
  • Labor disruptions
  • Supply chain conditions
  • Venue receiving restrictions

6. Risk of Loss & Title

  • Title and risk of loss pass to the customer once the shipment is tendered to the carrier
  • Carrier confirmation of delivery constitutes proof of receipt

7. Delivery Responsibilities

The customer is responsible for:

  • Providing an accurate delivery address
  • Ensuring the delivery location can accept the shipment
  • Confirming venue receiving policies
  • Being available for scheduled freight appointments

Missed deliveries, refusals, or incorrect address issues may result in additional charges passed through to the customer.

8. Exchanges

Exchanges are only offered for items that arrive defective or damaged in transit and are limited to the same item.

9. Chargebacks & Payment Disputes

Customers agree to contact us prior to initiating any chargeback or payment dispute.

We reserve the right to dispute chargebacks using:

  • Proof of purchase
  • Shipping and delivery records
  • Carrier documentation
  • These published Terms & Conditions

Chargebacks initiated in violation of these Terms may result in:

  • Account suspension
  • Refusal of future service

10. Limitation of Liability

To the fullest extent permitted by law:

  • We are not liable for indirect, incidental, or consequential damages
  • Our maximum liability shall not exceed the amount paid for the product giving rise to the claim
  • We are not responsible for lost profits, event delays, labor costs, or venue penalties

11. Warranty Disclaimer

Products are provided “as is” unless otherwise stated.

We disclaim all implied warranties, including but not limited to:

  • Merchantability
  • Fitness for a particular purpose

12. Indemnification

You agree to indemnify and hold harmless our company, affiliates, officers, employees, and partners from any claims, damages, losses, or expenses arising from:

  • Improper use of products
  • Installation errors
  • Violation of these Terms

13. Force Majeure

We are not liable for failure or delay due to causes beyond our reasonable control, including but not limited to acts of God, weather events, labor disputes, pandemics, or transportation failures.

14. Governing Law & Venue

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles.

Any disputes shall be resolved exclusively in the state or federal courts located in Georgia.

15. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.

16. Modifications to Terms

We reserve the right to update or modify these Terms at any time without prior notice. Continued use of the website constitutes acceptance of the revised Terms.
